The short answer
Letter is 8.5 by 11 in. Legal is 8.5 by 14. A legal folder does not fit a letter-only drawer, and a letter folder in a legal drawer wastes 3 in of width per file. For almost every household the answer is letter: unless you hold deeds, court papers or older contracts, nothing you own is legal size. Most laterals take both on adjustable rails, which is one more reason the lateral format is the easier purchase.

Rail spacing is the nominal distance the hanging folder's hooks sit apart. It is why a legal-capable cabinet is physically wider rather than deeper.
The key insight is that the difference is in WIDTH, not depth. Both sizes are 8.5 in across. Legal is 3 in longer, and in a hanging file that length runs along the rail. So a legal-capable vertical cabinet is wider - about 18 in rather than 14 to 15 - and the same depth.
Which cabinets take which
Across the twenty-one cabinets in our set, the pattern is consistent and worth knowing before you shop.
Most laterals take letter, legal AND A4 on adjustable rails. BIZOEIRON, Greenvelly, all three Letayas and INTERGREAT all state multiple formats.
Most verticals are letter only. The Staples letter cabinets, VASAGLE and VINGLI all name letter and nothing else.
A few budget verticals take all three. SISESOL, BYNSOE and the SISESOL rolling cabinet all name letter, legal and A4, which is unusual at that price and worth knowing.
One Staples vertical is titled letter/legal but its feature text names only letter hanging files. Where a listing contradicts itself, assume the narrower claim.

So do not buy for legal speculatively. Work out whether you actually have legal-size paper first, which takes about a minute: pull the longest document you own and measure it. If it is 11 in, you file letter.
What is actually legal size
A short list, because most people overestimate how much of it they have.
Property deeds and some mortgage documents, particularly older ones.
Court filings and some legal correspondence. The name is not a coincidence.
Some commercial contracts, mostly historic. Modern practice has largely moved to letter.
Some engineering and architectural schedules, though drawings are larger again and do not fit either format.
Nothing routine is legal size. Bank statements, utility bills, tax returns, medical records, warranties, payslips and insurance policies are all letter. If your filing is household paperwork, it is letter filing.
Mixed filing, and how to handle it
The common real situation is a lot of letter and a handful of legal documents - the deeds, one old contract.
Three ways to handle it, in order of how much we would recommend them:
01Put the legal documents in the fire box instead. Deeds and contracts are exactly the documents whose originals matter, and a certified box is where they belong anyway. That usually eliminates the problem entirely. Fireproof file cabinet vs safe.
02Buy a lateral with adjustable rails and set one drawer for legal and the rest for letter. Clean, flexible, and it is what the adjustable rail is for.
03Fold or file legal documents flat in a separate box. Workable and the least satisfying, because a folded deed is a folded deed forever.
The cheap retrofit
If you already own a deep drawer with no rails - a desk drawer, an old commercial cabinet, a stack of banker's boxes - a universal hanging file frame is about 13 dollars and takes letter AND legal, with breakable notches every half inch for adjustment.
Measure first: it fits 24 to 27 in deep drawers, which rules out almost every home-office cabinet in our set at 15 to 19 in. It is designed for deep commercial drawers and banker's boxes, and in those it is the cheapest filing capacity available anywhere.

We round that to 3 in and apply it to every other cabinet's published external figure. It is derived from one lateral cabinet, so applying it to verticals is an assumption and we label it as one every time.
